1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Strydly ApS ("Strydly," "we," "us," or "our") governing your access to and use of the Strydly mobile application and related services (collectively, the "Service").

By creating an account, downloading the app, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

You must be at least 16 years old to use Strydly. By using the Service, you represent that you meet this age requirement.

2. Description of Service

Strydly is a fitness and training platform that allows you to:

  • Track and analyze workouts and activities
  • Plan future training sessions
  • Sync activities from connected devices (Garmin, Apple Watch)
  • Import historical data from other platforms (Strava)
  • View detailed activity analytics and metrics
  • Access AI-powered coaching insights (Supporter tier)

The Service is currently available on iOS devices through the Apple App Store.

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. User Responsibilities

When using the Service, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Upload false, misleading, or fraudulent data
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any commercial purpose without our written consent
  • Reverse engineer, decompile, or disassemble the app
  • Use automated systems or bots to access the Service
  • Interfere with or disrupt the Service or servers
  • Transmit viruses, malware, or other harmful code

We reserve the right to suspend or terminate your account for violations of these terms.

5. Subscriptions and Payments

5.1 Free Tier

Strydly offers a comprehensive free tier that includes core features such as activity tracking, workout planning, device syncing, and analytics. The free tier is available indefinitely at no cost.

5.2 Supporter Tier

The Supporter tier is an optional subscription that provides access to advanced AI coaching features and supports the ongoing development of Strydly. The Supporter tier is available as an in-app purchase through the Apple App Store.

5.3 Payment Terms

If you subscribe to the Supporter tier:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID account settings

5.4 Refunds

Refunds for in-app purchases are handled by Apple in accordance with their refund policies. To request a refund, please contact Apple Support.

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, content, and underlying code, is owned by Strydly ApS and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

6.2 Your Content

You retain ownership of the data and content you upload to the Service (such as activities, notes, and profile information). By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use and implement such feedback without any obligation to you.

7. Third-Party Services

The Service integrates with third-party services to enhance your experience:

  • Garmin Connect: Sync activities and health data from Garmin devices
  • Apple HealthKit: Access workout and health data from Apple devices
  • Strava: Import historical activity data

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

You may disconnect third-party services at any time through your account settings.

8. Health Disclaimer

Important Notice

Strydly is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.

The Service provides fitness tracking and training tools for informational purposes only. It does not provide medical advice. Always consult a qualified healthcare professional before:

  • Starting any new exercise program
  • Making decisions about your health based on data from the app
  • If you have any medical conditions or concerns

You use the training recommendations, AI coaching suggestions, and health-related features at your own risk. Strydly is not liable for any injuries, health issues, or damages resulting from your use of the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of any data or content

We do not guarantee that GPS, heart rate, or other metrics will be accurate. Data from connected devices may contain errors or inconsistencies beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRYDLY ApS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, or goodwill
  • Any damages resulting from your use or inability to use the Service
  • Any damages resulting from unauthorized access to your data

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Strydly ApS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties.

12. Termination

You may terminate your account at any time by deleting your account through the app settings or by contacting us at hello@strydly.com.

We may suspend or terminate your account at our discretion if:

  • You violate these Terms
  • Your use poses a security risk to the Service or other users
  • We are required to do so by law
  • We discontinue the Service (with reasonable notice)

Upon termination, your right to use the Service will cease immediately. You may request export of your data before account deletion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.

14. Dispute Resolution

If you have a dispute with us, we encourage you to first contact us at hello@strydly.com to seek an informal resolution.

For users in the European Union, you may also submit disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

Any legal proceedings shall be brought exclusively in the courts of Denmark, unless you are a consumer entitled to bring proceedings in your country of residence under applicable law.

15. Changes to Terms

We may update these Terms from time to time. When we make changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify you of material changes through the app or via email
  • Give you reasonable time to review changes before they take effect

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.
